Laya Falsafi

Laya qualified as a barrister in 1991 and after a period of practice at the commercial Bar, she qualified as a solicitor in 2006. Her background as both a court room advocate and solicitor has enabled her to develop a broad commercial practice with significant expertise in providing strategic advice to individuals and businesses on all aspects of their immigration, employment and commercial needs.

She is also fluent in Farsi, French and Spanish which has been of benefit to many of her international clients.

Immigration

Laya has over 15 years specialist experience in UK immigration and nationality law dealing with all types of visa applications for businesses and foreign companies, individuals (including European nationals) and their families.

She also works closely with employers and education providers in connection with corporate due diligence and issues arising from sponsorship licences and prepares them for the constant changes in policy affecting the day to day running of their operations. She is often involved in challenging decisions made by the UKBA to suspend and/or revoke sponsorship licences and has successfully challenged a number of adverse immigration decisions through judicial review.

Laya has a broad international client base and regularly handles visa applications for high net worth individuals and those wishing to set up in business in the UK. In advising such clients, Laya is often involved in providing commercial solutions that compliment the wider issues facing businesses and individual investors in the UK.

Employment

Laya has over 10 years specialist experience in both contentious and non-contentious employment law predominantly acting for employers. Her main focus is on the careful handling of workplace disputes, and advising client's on how best to navigate through the various employment laws to ensure claims are avoided. To that end she works closely with senior managers and HR departments and is regularly involved in advising on internal policies dealing with disciplinary and grievance issues, staff performance monitoring, drafting of employment contracts and staff handbooks, and the handling of redundancy consultation and termination procedures.

She is an experienced litigator and where claims cannot be avoided, represents her clients in the Employment Tribunal in a broad range of matters including unfair dismissal, discrimination, injunction proceedings, restrictive covenant and other breach of contract claims.
